Description The Environmental Protection Agency (EPA) issued a Notice of Data Availability (NODA) on October 12th, in part, requesting comments regarding negative stigma associated with beneficial use as a result of their proposed rule on disposal of coal combustion residuals (CCRs), commonly known as fly ash. The notice invited comments to be submitted by November 14th. Attached is a list of damage cases that NRMCA will submit before the deadline. Please review the draft and send any additional examples of damage cases you have come across. Since the comment period is so short, please submit any examples by close of business next Friday, November 7th. This email will be sent to all relevant NRMCA committees, but please feel free to forward this email to anyone you think can help strengthen our list of examples.
